1. Acceptance of Terms

By accessing the Site or enrolling a child in any HappyFeet KC class, league or event (collectively, the “Programs”), you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Services.

2. Eligibility & Accounts

Parents/guardians must be at least 18 years old to create an account and register a minor participant. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

3. Registration, Fees & Payment

All fees must be paid in full at the time of registration unless a payment plan is offered and selected. Prices are subject to change until you complete checkout. Payments are processed by a PCI DSS compliant gateway; we do not store full credit card numbers.

3.1 Refund & Cancellation Policy

  • Withdrawals requested ≥14 days before the program start receive a full refund less a $25 administrative fee.
  • Withdrawals requested <14 days before the start, or after the season begins, receive a prorated credit for future programs at our discretion.
  • No refunds for missed sessions due to participant absence.
  • If we cancel a session for weather or facility issues, we will schedule up to two make up dates; otherwise a credit will be issued.

4. Program Participation & Assumption of Risk

Soccer involves inherent physical risks. By enrolling, you (a) certify that the participant is medically cleared, (b) understand and voluntarily assume all such risks, and (c) release HappyFeet KC, its coaches, owners and facilities from liability for ordinary negligence to the fullest extent permitted by law.

5. Health & Safety Requirements

Participants must follow staff instructions and any venue specific rules. Parents must disclose relevant medical conditions or allergies during registration. We reserve the right to remove a participant whose behavior poses a safety risk or materially disrupts the Program; no refund will be due in such event.

6. Media Release

With your consent during checkout, photos or videos of the participant may be used in HappyFeet KC marketing materials. You may revoke consent any time by emailing [email protected].

7. Code of Conduct

We promote a fun, positive environment. Parents, spectators and players must:

  • Treat all children, coaches and officials respectfully;
  • Refrain from disruptive sideline coaching or abusive language;
  • Follow staff directions regarding field boundaries and equipment.
  • Failure to comply may result in removal from the venue.

8. Intellectual Property

All Site content, curriculum, graphics, logos and trademarks are owned by HappyFeet KC or its licensors. You may not reproduce, distribute or make derivative works without prior written consent.

9. Prohibited Website Uses

You agree not to: (a) engage in unlawful, defamatory or abusive conduct; (b) attempt to gain unauthorized access to our systems; (c) use any automated means to scrape or data‑mine the Site; or (d) upload malicious code.

10. Third‑Party Links

The Site may contain links to external sites (e.g., social media, payment gateways). We are not responsible for their content or privacy practices.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non‑infringement.

12. Indemnification

You agree to indemnify and hold HappyFeet KC, its affiliates, coaches and staff harmless from any claims, damages or expenses arising from (a) your breach of these Terms, or (b) the participant’s conduct during Programs.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Kansas, without regard to conflict‑of‑laws principles. Any legal action must be filed in the state or federal courts located in Johnson County, Kansas.

14. Dispute Resolution; Arbitration (Optional)

At our sole discretion, we may require that any dispute be submitted to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association in Kansas City, Missouri. Each party will bear its own costs.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be emailed to registered users and take effect 30 days after posting. Continued use of the Services constitutes acceptance of the revised Terms.
